HouzGPT ("HouzGPT," "we," "us," or "our") respects your privacy and is committed to protecting your personal information. This Privacy Policy explains how we collect, use, disclose, and protect your personal information when you interact with the HouzGPT Platform. This policy applies exclusively to information collected through www.houzgpt.ca and associated Platform services.

By using the Platform, you consent to the practices described herein.

2. Definitions

For the purposes of this Privacy Policy, "Personal Information" means information about an identifiable individual as defined under PIPEDA and applicable provincial law, excluding information that has been aggregated or anonymized such that it cannot reasonably be used to identify an individual. "VOW" refers to a Virtual Office Website operated in accordance with the rules and policies established by the Toronto Regional Real Estate Board ("TRREB"). "Licensed Professional" refers to a real estate salesperson, broker, or brokerage duly licensed under the laws of Ontario.

3. Scope of Application

This Privacy Policy applies to Personal Information collected through the Platform, including information collected through account registration, inquiry submissions, AI-driven conversational interactions, VOW authentication and access, and communications between users and HouzGPT. This Policy does not apply to third-party websites, brokerages, Licensed Professionals, or service providers that maintain independent privacy policies governing their own data collection practices.

4. Collection of Personal Information

HouzGPT collects Personal Information that individuals voluntarily provide when interacting with the Platform. Such information may include name, email address, telephone number, property preferences, financial or budget-related information, account credentials, inquiry content, and information submitted through AI chat functionality. Where required for VOW access, we may also collect registration and authentication information necessary to comply with TRREB rules. The provision of certain Personal Information may be necessary to access specific features of the Platform.

In addition to information provided directly, HouzGPT may automatically collect certain technical and usage information when individuals access or use the Platform. This may include IP address, device identifiers, browser type, operating system, session information, clickstream data, referring URLs, and similar information collected through cookies and tracking technologies. Such information is used for system administration, analytics, fraud detection, compliance monitoring, performance optimization, and security purposes.

Where users engage with AI-powered tools or conversational interfaces on the Platform, HouzGPT may collect and retain the content of user inputs, system-generated outputs, and related metadata, including timestamps and interaction patterns. Such information may be used for quality assurance, service improvement, performance monitoring, personalization, and security review. AI-generated responses are provided for informational purposes only and do not constitute legal, financial, or real estate advice.

5. Purpose of Use

HouzGPT collects, uses, and processes Personal Information for legitimate business purposes, including the provision and operation of property search tools, VOW services, AI-driven insights, user support, and lead routing functionality. Personal Information may be used to respond to inquiries, facilitate connections with Licensed Professionals, personalize content and property recommendations, improve system functionality, monitor compliance with TRREB rules, detect and prevent fraud or misuse, and fulfill legal and regulatory obligations. HouzGPT limits its collection of Personal Information to that which is reasonably necessary for these purposes.

6. Disclosure of Personal Information

HouzGPT may disclose Personal Information to Licensed Professionals or brokerages where a user submits an inquiry, requests assistance, or otherwise indicates interest in real estate services. By submitting such information through the Platform, users expressly consent to the disclosure of their Personal Information for the purpose of facilitating real estate services and acknowledge that they may be contacted by the relevant Licensed Professional. Once disclosed, such Licensed Professionals are independently responsible for complying with applicable privacy laws in respect of their handling of Personal Information.

HouzGPT may also disclose Personal Information to third-party service providers retained to support the operation of the Platform, including providers of cloud hosting, data storage, analytics, communications infrastructure, security monitoring, and customer relationship management services. These service providers are contractually required to safeguard Personal Information and are restricted from using such information for purposes other than those authorized by HouzGPT.

Personal Information may further be disclosed where required to comply with legal obligations, lawful requests by governmental or regulatory authorities, court orders, TRREB audit requirements, or where necessary to protect the legal rights, property, or safety of HouzGPT, its users, or others.

We collect personal information only when voluntarily provided by you or as necessary to operate the Platform and provide services. This includes:

• Identity & Contact Data: Name, email address, phone number, and any other contact information you provide when submitting inquiries, registering, or communicating through the Platform.
• Usage Data: Information regarding your interaction with the Platform, including pages visited, features used, forms submitted, and AI-generated interactions.
• Lead Qualification Data: Responses, selections, or preferences provided when completing inquiry forms or surveys.
• Technical Data: IP address, browser type, device type, operating system, and log files to ensure Platform functionality and security.

7. TRREB VOW Compliance

Access to certain real estate listing data is governed by the VOW rules established by TRREB. In accordance with those requirements, users may be required to complete registration and authentication procedures before accessing certain listings. User activity may be monitored and logged to ensure compliance with VOW rules. Listing data accessed through the VOW may not be reproduced, redistributed, or used for commercial purposes in violation of TRREB policies. Personal Information collected in connection with VOW access may be retained for auditing, compliance, and enforcement purposes as required by TRREB.

8. Automated Processing and Profiling

HouzGPT utilizes automated systems, including artificial intelligence technologies, to generate conversational responses, analyze user preferences, personalize property recommendations, and improve lead matching functionality. Automated processing may involve profiling based on user interaction patterns and expressed preferences. Such processing is conducted for legitimate business purposes and does not result in legally binding decisions without appropriate human involvement.

9. Retention of Personal Information

HouzGPT retains Personal Information only for as long as necessary to fulfill the purposes described in this Privacy Policy, to comply with legal and regulatory obligations, to meet TRREB auditing requirements, and to resolve disputes or enforce agreements. Upon the expiration of applicable retention periods, Personal Information is securely destroyed or irreversibly anonymized.

10. Safeguards

HouzGPT maintains reasonable administrative, technical, and physical safeguards designed to protect Personal Information against unauthorized access, disclosure, alteration, or destruction. Such safeguards include encrypted transmission protocols, access controls, authentication mechanisms, secure hosting environments, and system monitoring measures. While we employ commercially reasonable security practices, no method of electronic transmission or storage can be guaranteed to be completely secure.

11. Consent and Withdrawal

By providing Personal Information or using the Platform, individuals consent to the collection, use, and disclosure of their Personal Information in accordance with this Privacy Policy. Consent may be withdrawn at any time, subject to legal or contractual restrictions and reasonable notice; however, withdrawal of consent may limit the availability of certain Platform features.

12. Access and Correction

Individuals have the right to request access to the Personal Information held by HouzGPT and to request correction of inaccurate or incomplete information. Requests for access, correction, or deletion, subject to applicable legal retention requirements, may be submitted to support@houzgpt.ca. HouzGPT will respond in accordance with applicable law.

13. Children

The Platform is not intended for use by individuals under 18 years of age. HouzGPT does not knowingly collect Personal Information from minors.

14. Amendments

HouzGPT reserves the right to amend this Privacy Policy from time to time. Any revised version will be posted on the Platform with an updated effective date. Continued use of the Platform following the posting of revisions constitutes acceptance of the amended Privacy Policy.
